Introduction:

Contracts are needed in every day dealings. They range from simple contracts to very sophisticated ones and accordingly, such need and variance in nature and types stimulated engineers and law makers to develop such contracts and in particular in the construction contracts to control the relationships between the parties to the contract and to determine the rights and obligations of each party towards the other party(ies).

All those who are involved in the construction process such as project managers, contract administrators, procurement engineers, quantity surveyors, bankers, etc. need to be aware of the types of contracts, contract forms, roles of the contracting parties, roles of the engineer and the construction management firm if present, how to deal with the site conditions, the physical and environmental conditions, contract duration(s), extensions of time, variations, claims, disputes, settlement of disputes, etc.

The workshop will provide an understanding of the main contract types and contract forms in use in the State of Qatar, the legal background of the contracts, the roles of the Employer, the Engineer and the Contractor,

The objective of this workshop is to provide participants with a comprehensive understanding of elements of the contract and the roles and techniques in managing and administering the contract.

Objectives:

Upon completion of this workshop, participants are expected to be able to:



• Identify and understand the legal aspects of construction contract;

• List the types of contracts, Forms of contracts and their elements;

• Understand and review of contracting terms and definitions, contract management tools and techniques; contract life cycle management, software tools used in contract management and administration;

• Identify contracts used on Complex Projects; contract frameworks for complex multinational projects, complex projects involving several contracts;

• Understand the management of Change within the contract, modifications, variations, breaching and termination;

• Manage the payments within the Contract Terms, deductions, penalties / liquidated damages, compensations, etc.

• Understand contract management within the project environment; the position of the contract manager and administrators within the project team, empowerment of the contract manager and administrators within the project team and transparency within the team;

• Define the process of contract administration, technique, accountability and authority

• Identify the tools required and the roles of the contract administrator

• Have expertise and knowledge management, identifying and incorporating the lessons learned from past the contracts, auditing, equitable and ethical contracts

• Identify main causes of claims, measures to minimize them, handling and processing them;

• Understand dispute management; managing dispute within the contracted scope of services, preparing counter claims, resolution of disputes;

• Become aware of the roles and duties of the Dispute Adjudication Board

• Become familiar with the different approaches of dispute resolution

• Decide the best approach to choose the suitable approaches to settle disputes
